Werner Media and Consumer Benefits Services, the publisher behind popular magazine titles Rolling Stone and US Weekly, has been hit with a class action lawsuit over an aggressive SMS marketing campaign in violation of the TCPA (Telephone Consumer Protection Act). Werner Media have allegedly sent unsolicited text messages to consumers cell phones offering vouchers for magazine subscriptions, which is in violation of section 227 of the TCPA which restricts the use of ‘automatic dialling systems’ to cell phones.
